These Terms of Use ("Terms") govern your access to and use of fastwisely.com and related tools (the "Service"), operated by Top Of Mind Technologies L.L.C., a California limited liability company doing business as FastWisely ("FastWisely," "we," "us," or "our").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Not medical advice

FastWisely provides general educational information and self-help tools only. Nothing on the Service is medical advice, diagnosis or treatment, and nothing creates a doctor–patient relationship.

Estimates are not guarantees

Calculators, quizzes, timelines, charts and sample plans on the Service are rough estimates for planning only. Weight change, energy levels and other outcomes vary widely. We do not promise, and nothing on the Service guarantees, any specific result. Past or illustrative examples are not predictions of your results.

Eligibility

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to enter a binding agreement. The Service is not directed to children.

Accounts and submissions

You may use parts of the Service without creating an account. When you submit an email, quiz answers or a contact message, you agree that the information is accurate and that you have the right to provide it. You are responsible for the content of your messages. Do not submit someone else's personal information without permission.

Intellectual property

The Service, including text, layout, logos, calculators and code (other than open-source components used under their licenses), is owned by Top Of Mind Technologies L.L.C. or its licensors. You receive a limited, revocable, non-exclusive license to use the Service for personal, non-commercial purposes in accordance with these Terms.

The Service is hosted on Cloudflare. Links to third-party sites are provided for convenience; we are not responsible for their content or practices.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT RESULTS FROM USING THE TOOLS WILL MEET YOUR EXPECTATIONS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOP OF MIND TECHNOLOGIES L.L.C., ITS OWNERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnity

You agree to defend and indemnify Top Of Mind Technologies L.L.C. and its owners against claims, damages and expenses (including reasonable attorneys' fees) arising from your misuse of the Service or your violation of these Terms, to the extent permitted by law.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You agree that courts located in California have exclusive jurisdiction over disputes arising from these Terms or the Service, except that we may seek injunctive relief in any jurisdiction. If you are a consumer, mandatory consumer-protection rules of your place of residence may also apply.

Changes

We may update these Terms from time to time. The effective and last-updated dates at the top will change when we do. Continued use after an update means you accept the revised Terms. If you do not agree, stop using the Service.
